I. Definitions

  1. Terms – the following terms and conditions for the provision of electronic services, governing the terms and conditions of use of the Website.
  2. Website – website containing a blog along with tutorials, maintained by the Owner, located at: https://ideaspot.tv
  3. Website’s owner (Owner):
    • Artur Karczmarczyk – An entrepreneur running a business under the name: „IdeaSpot Artur Karczmarczyk”, Address: ul. Niemierzyńska 17A, local 208, 71-441 Szczecin; REGON: 321513751; NIP: 8522437740
  4. User – an individual who is interested in the content of the Website and who uses the Tutorials provided on the Website.
  5. Tutorials – educational material in electronic form (videos, text files) on the Website in the form of an instructional video.
  6. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

II. General provisions

The Terms set out the rules for the use of the Website, including in particular the rights and obligations of the parties. Acceptance of the provisions of the Terms is voluntary, although necessary for the use of the Website.

III. Technical requirements

The correct use of the Website and the correct display of the Website page does not require the installation of any special software. It is sufficient in this respect to meet the minimum technical requirements for using the Internet, i.e. an Internet connection and an Internet browser in the latest version possible.

IV. Use of the Website

  1. Users of the Website may be natural persons who are at least 18 years of age and have full legal capacity.
  2. The use of the Website, in particular Tutorials, is free of charge and does not require registration of a User account.

V. User rights and obligations

  1. Each User has the right to use the Website, including the Tutorials contained therein, in a manner consistent with the Terms.
  2. Each User undertakes to:
    1. observe generally accepted rules of social coexistence, good manners and netiquette when using Tutorials and when posting comments under Tutorials.
    2. comply with other provisions of the Terms.
  3. It is forbidden under penalty of law to claim damages:
    1. access the Website and the content in any way other than as described in the Terms;
    2. to copy, distribute or share Tutorials from the Website to third parties;
    3. to knowingly or unknowingly destabilize the Website, e.g. by sending mass messages within the Website, attempts to create fictitious accounts, also with the help of automated machines, searching for gaps in security and using them to attack the Website or access the Tutorials, etc;
    4. violating the personal rights and rights of the Owner, other Users and third parties;
    5. spreading and inciting racial, ethnic or religious hatred and intolerance, as well as promoting websites of this nature;
    6. promote erotica, pornography, gambling, phonographic and computer piracy on the Website, as well as websites of this or similar nature;
    7. to place on the Website information about competing portals;
    8. use the Website for the purpose of advertising or surreptitious advertising;
    9. other unlawful activities.

VI. Rights and obligations and liability of the Website’s Owner

  1. The Tutorials contained in the Website are protected by copyright in accordance with the relevant provisions of the law, including the Act of 4 February 1994 on Copyright and Related Rights.
  2. The copyright in the Tutorials belongs to the Owner or the authors of the Tutorials.
  3. The Owner shall make every effort to ensure that the Website is available and functioning properly at all times, and that the Tutorials posted on the Website are substantively correct and up-to-date.
  4. Administrators, on behalf of the Owner, monitor comments and other statements posted by Users and ensure that they observe generally accepted netiquette.
  5. The Owner shall not be liable for any damage that the User might incur or has incurred in connection with the use of the Website, in particular resulting from:
    1. malfunctioning or unavailability of the Website, e.g. due to failures, technical interruptions, loss of transmitted data or force majeure;
    2. factual errors, unclear or outdated information contained in the Tutorials that could mislead the User;
    3. non-compliance by Users with the rules of social coexistence and netiquette, including offensive statements, violating the personal rights of Users and third parties;
    4. other unauthorised and unlawful actions by Users or third parties.
  6. The Owner will not be involved in any possible disputes between Users or between Users and third parties.
  7. If it is found that a User violates the personal rights of the Owner, the Owner has the right to take appropriate legal action, including legal action.
  8. The Owner has the right to block access to the Website for Users who do not comply with the Terms.

VII. Protection of personal data

  1. The provision of personal data by the User, such as name or email address, for the purposes of using selected functionalities of the Website (leaving a comment on the Website) is voluntary, but necessary for the use of the Website.
  2. The Owner protects the personal data of Users in accordance with the law, in particular the GDPR.
  3. The Owner shall only use the Users’ data in order to ensure the proper operation of the Website and to enable them to use the Tutorials and other functionalities and for statistical purposes. Statistics will only be used for the development and improvement of the Website and the Tutorials contained therein. Users’ data will not be shared with other third parties.
  4. Detailed rules concerning the processing of personal data by the Owner are regulated in the Privacy Policy (web address: Privacy Policy).

VIII. Complaints

  1. Any comments related to the functioning of the Website, the User may report by sending a complaint to the Owner’s e-mail address: grpr@ideaspot.tv.
  2. The complaint should include:
    1. indication of the User’s data in such a way that the User can be identified;
    2. the subject of the complaint;
    3. circumstances justifying the complaint;
    4. indication of the demand.
  3. Complaints shall be considered by the Owner within no more than 30 days of receipt if the User formulates the complaint in a clear and transparent manner.
  4. In the event of incompleteness or ambiguity preventing the complaint from being considered within the aforementioned period, the Owner shall request the User to complete the complaint within 7 days. If the request is ineffective, the complaint shall be left unprocessed.
  5. The User shall be notified of the decision on the complaint at his current e-mail address.
  6. If the Owner does not respond to the complaint within 30 days of its receipt, it shall be deemed to have acknowledged the complaint.

IX. Final provisions

  1. In matters not covered by these Terms the relevant provisions of Polish common law shall apply.
  2. The court competent to adjudicate any disputes between the User and the Owner is the court of local and material jurisdiction for the registered office of the Owner.
  3. These Terms shall enter into force on 2.01.2023.
  4. The Owner has the right to amend these Terms without prior notice.
  5. Information on amendments to the Terms will be provided on the home page and will be displayed there for at least 3 months after they come into force, unless the Terms are amended again during this period. In this case, the provisions of the previous sentence shall also apply to the new version of the Terms.
  6. The amendments referred to in paragraph 4 shall come into force 7 days after the Owner has made them available to the User.
  7. The current version of the Terms is always available at WWW: https://idespot.tv/terms.
  8. The User declares that he has familiarised himself with the Terms currently in force and agrees to their terms.
  9. Otherwise, in particular in the case of not agreeing to the amended wording of the Terms made in accordance with paragraphs 4-6, the User is obliged to stop using the Website and the Tutorials contained therein.
